Terms of Service

1. Scope
These terms apply to the use of QMenu (qmenu.ch), a digital QR menu service operated by Thomas Tatas (“we”). The service is for restaurants, cafés, bars and other businesses (“customer”), not for consumers. Guests who only view a menu do not enter into a contract with us.
2. The service
We provide the customer with a dashboard to create its menu in the languages it subscribes to, generate a QR code and publish the menu online, plus optional ordering and payment at the table. The website at the time of signing describes the exact scope. We may develop the service further as long as the subscribed core features remain.
3. Prices, free trial and payment
- CHF 50 per language per month, or CHF 220 per month for all languages, plus VAT where applicable.
- The first 14 days of a new subscription are free. If the subscription is not cancelled before the trial ends, it automatically continues as a paid subscription.
- Billing is monthly in advance through our payment provider Stripe. If payment is overdue, we may temporarily suspend the menu after an unsuccessful reminder.
- We announce price changes by email at least 30 days in advance; the customer may then cancel with effect from the change.
4. Term and cancellation
The subscription runs monthly and renews automatically. The customer can cancel at any time in the dashboard under “Billing”, effective at the end of the current month; months already paid are not refunded pro rata. We may cancel with 30 days' notice to the end of a month, or immediately for a serious breach of these terms.
5. Customer content
- The customer alone is responsible for its menu, in particular for correct prices and complete, accurate information on allergens, ingredients and origin as required by food law. The customer must check any automatic translations or suggestions before publishing.
- The customer only uploads photos, texts and logos it holds the rights to, and indemnifies us against third-party claims arising from its content.
- The customer allows us to store and display its content to run the service. We may name its public menu as a reference unless it objects.
6. Availability
We aim for uninterrupted operation but do not guarantee a specific availability. Where possible, maintenance happens outside restaurants' main business hours. We back up the data daily.
7. Liability
We are liable for damage we cause intentionally or through gross negligence. Liability for slight negligence, indirect damage and lost profit is excluded to the extent the law permits. In total, our liability is limited to the amounts the customer paid in the 12 months before the damage occurred.
8. Data protection
Our privacy policy explains how we process personal data. Where we process guests' data on the customer's behalf (such as orders), we do so only on its instructions and to run the service.
9. Changes to these terms
We may change these terms and will inform the customer by email at least 30 days in advance. If the customer does not cancel before they take effect, the new terms are deemed accepted.
10. Governing law and jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is [place of jurisdiction — to be added].
